License Agreement for Gublists(tm) 1.0

You should carefully read the following terms and conditions before using this software. Unless you are a party to a different license agreement signed by Scott Burleigh ("SB"), your use, distribution, or installation of Gublists 1.0 ("Gublists") indicates your acceptance of this Agreement.

If you do not agree to any of the terms of this Agreement, then do not install, distribute, or use Gublists.

SOFTWARE. Gublists comprises two complementary software elements: an application development library that implements the Gublists application programming interface ("API"), and a sample application ("GLDemo"). API is provided in executable form (Java byte codes) only, while GLDemo is provided in the form of Java source code.

YOUR RIGHTS. Under the terms of this Agreement, you may:

Store one copy of API and one copy of GLDemo in such a way that each may be directly accessed for use by at most one computer at any time.
Retain one additional "backup" copy of both API and GLDemo on some medium from which they can be accessed solely for the purpose of recovering from Gublists software loss or damage, but not for use.
Use GLDemo as a basis for the development of one or more software applications that utilize API.
Deploy or operate any number of software applications that utilize API, provided that such deployment or operation does not entail the distribution of copies of API or GLDemo in violation of this Agreement.

You may not:

Distribute copies of API or GLDemo to any third party without the express written consent of SB.
Decompile, disassemble, or reverse-engineer API in any way.
Modify API or create derivative works based on API except as expressly authorized in this Agreement.
Resell, rent, or lease API or any element thereof.

WARRANTY. This software, and all accompanying files, data, and materials, are distributed "AS IS" and with no warranties of any kind, whether express or implied. Good data processing procedure dictates that any program be thoroughly tested with non-critical data before relying on it. You assume the entire risk of using Gublists software. This disclaimer of warranty constitutes an essential part of this Agreement.

DISCLAIMER OF LIABILITY. Any liability of SB will be limited exclusively to refund of purchase price, where applicable. In no event shall SB be liable for any incidental, consequential, or punitive damages whatsoever relating to the use of Gublists or to your relationship with SB.

In addition, in no event does SB authorize you to use Gublists in applications or systems where Gublists's failure to perform can reasonably be expected to result in a significant physical injury, or in loss of life. Any such use by you is entirely at your own risk, and you agree to hold SB harmless from any claims or losses relating to such unauthorized use.

GOVERNING LAW. This Agreement is the complete statement of the agreement between you and SB regarding Gublists. It merges and supersedes all other or prior understandings, purchase orders, agreements and arrangements.

This Agreement shall be governed by the laws of the State of California. Exclusive jurisdiction and venue for all matters relating to this Agreement shall be in courts located in the State of California, and you consent to such jurisdiction and venue.

All rights of any kind in Gublists which are not expressly granted in this Agreement are entirely and exclusively reserved to and by SB. There are no third party beneficiaries of any promises, obligations or representations made by SB herein.
